1. Acceptance of Terms

By accessing and using Hashtag Tools ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to use the Service for personal and commercial purposes, subject to the following restrictions:

  • You may not redistribute, sell, or resell access to the Service
  • You may not reverse engineer or attempt to extract the source code
  • You may not use the Service for any illegal or unauthorized purpose
  • You may not use the Service to generate spam or misleading content

3. User Accounts

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

4. AI-Generated Content

Our Service uses artificial intelligence to generate hashtag suggestions. While we strive for accuracy and relevance:

  • We do not guarantee the effectiveness of any generated hashtags
  • You are responsible for reviewing and approving all generated content before use
  • Generated content should comply with the terms of service of the platforms where you use them
  • We are not responsible for any consequences resulting from the use of generated content

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Hashtag Tools and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6. Paid Products and Payment Processing

Some products and features on Hashtag Tools are offered for purchase. By placing an order, you agree to the pricing, payment, and refund terms in effect at the time of purchase.

6.1 Merchant of Record

Purchases on Hashtag Tools are processed by Paddle.com Market Limited ("Paddle") as the Merchant of Record. Paddle handles all payment processing, sales tax, VAT, and invoicing on our behalf. Your contract for the purchase is with Paddle; Hashtag Tools is the supplier of the digital product.

6.2 Pricing and Taxes

Prices shown at checkout are inclusive of applicable VAT and sales tax for your jurisdiction, calculated and collected by Paddle. We reserve the right to adjust prices at any time; changes do not affect orders already placed.

6.3 Digital Product Delivery

Digital products (PDFs, downloadable reports, subscription access) are delivered to the email address you provide at checkout, typically within minutes of payment confirmation. If delivery fails for any reason, contact us via the contact form and we will resend.

6.4 EU/UK Right of Withdrawal — Express Waiver

For digital downloads, by completing your purchase you expressly consent to immediate access and acknowledge that you lose your statutory right of withdrawal under EU Directive 2011/83/EU and UK Consumer Contracts Regulations 2013 once the download has commenced. This does not affect your statutory rights in case of a faulty or non-delivered product.

6.5 Refunds

Refund eligibility and process are described in our Refund Policy.

6.6 Subscriptions (Hashtag Tools Pro)

Hashtag Tools Pro is an auto-renewing subscription that unlocks unlimited hashtag generations. Unless you cancel, it renews automatically at the end of each billing period and your payment method is charged the then-current price. You can cancel at any time from your account page; cancellation takes effect at the end of the current paid period, and you keep Pro access until then. Subscription refund eligibility is described in our Refund Policy.

7. Limitation of Liability

In no event shall Hashtag Tools, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Service Availability

We reserve the right to withdraw or amend our Service, and any service or material we provide, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Hashtag Tools operates, without regard to its conflict of law provisions.
